Overview
Marc McClain is a patent attorney who helps companies protect and leverage innovation in various industries, including interactive entertainment and artificial intelligence. His practice centers on patent preparation, drafting, and prosecution, along with intellectual property counseling and post grant proceedings including inter partes review and post grant review. Marc excels and providing strategic intellectual property guidance, advising on portfolio development/positioning, freedom to operate, product risk assessment, and general IP strategy aligned to business goals, product roadmaps, and commercialization plans. He works with clients ranging from early stage studios and technology startups to established companies, tailoring practical protection strategies to budgets, timelines, and market realities.
Marc’s technical experience spans software and hardware innovations, including AI enabled systems, game and platform technologies, augmented reality, video streaming, online learning, computer memory structures, and 3D model processing. He advises clients on building and positioning patent portfolios that support product development and long-term commercialization objectives. Marc also supports contentious matters and broader IP risk management, including helping clients deter potential patent infringers in other countries and defending against non-practicing entity demands.
In addition to client work, Marc is active in thought leadership and public education. He has spoken on various panels addressing AI both in the gaming industry and society at large. He has also delivered numerous presentations in recent years to social and civic clubs on AI in the news, current events, and the broader collective impact of the technology. Marc stays closely engaged with the rapidly evolving AI landscape by learning and experimenting with leading consumer AI tools, including testing, and utilizing open-source AI systems on local devices. This hands-on work helps him provide current, practical perspectives in the opinions and IP strategies he develops for clients.
Marc is admitted to the State Bar of California and is registered to practice before the U.S. Patent and Trademark Office. He has been recognized by Best Lawyers in America: Ones to Watch (2021 to 2026). Marc previously served as Chair of the Orange County Bar Association Intellectual Property and Technology Law Section (2019) and continues to engage with the community on practical IP and technology topics.
