Overview

Steve has developed a robust litigation practice representing a variety of clients in complex, commercial litigation matters, particularly related to the preparation and prosecution of construction and real estate related claims. Namely, Steve’s litigation practice includes representing both owners and nationally-recognized contractors and providing strategic legal advice to clients throughout all phases of the litigation lifecycle – including discovery and depositions, motion practice, mediations, arbitrations, and trials.

In addition, since joining Rutan, Steve has provided strategic legal counsel on a number of complex transactional matters, including drafting and negotiating master agreements, prime contracts and subcontracts. Steve’s transactional practice also includes advising clients through pre-litigation disputes, governmental investigations and claims preparation.

Experience

Representative Litigation Matters:

  • Counsel for a national electrical subcontractor firm in a Hawaii-based, multi-month arbitration against a real estate development company for more than $6M in claims covering breach of contract and quantum merit in connection with a luxury hotel redevelopment.
  • Counsel for a national electrical subcontractor firm in a California Superior Court litigation against a Fortune 100 company for more than $35M in claims covering breach of contract, recovery on a mechanics’ lien release bond and quantum merit in connection with construction on a large commercial building.
  • Counsel for a mechanical subcontractor in an Oregon-based arbitration against a Fortune 100 company for breach of contract and mechanics’ lien claims in connection with a $28M claim on a high-end commercial and retail development.
  • Counsel for a civil general contractor in a California Superior Court litigation, prosecuting and defending against claims made by a subcontractor in connection with a light-rail construction project.
  • Co-counsel for an equity firm in an Indiana-based arbitration against an EPC contractor for breach of contract, fraud / constructive fraud, and negligence in connection with the development of a bridge.
  • Co-counsel for an international developer in a commercial landlord-tenant dispute involving claims against sub-tenants.

  • Advisor to national developer in drafting and negotiations of sophisticated contract documents for multi-million dollar commercial and residential projects.
  • Counsel for national electrical subcontractor in drafting and negotiations of various construction agreements.
  • Counsel for national tech company developing a car charger application and corresponding hardware, to be installed at various locations throughout the United States.
  • Counsel for food manufacturer client in negotiations to construct a refrigerated processing and storage facility.
  • Counsel for national contractor involved in a multi-year investigation, which successfully ended in no claims.
