Rutan & Tucker LLP attorneys Steven Nichols, Steven Goon, and Lucas Hori obtained a $47,250,000 verdict on behalf of their clients racing legend Robby Gordon, Todd Romano, and Speed RMG Partners, LLC against Arctic Cat Inc., Arctic Cat Sales Inc., and Textron Specialized Vehicles Inc.
The case arose from a product development and marketing relationship between Rutan’s clients who asserted that the Arctic Cat defendants had accepted their designs for offroad side-by-side vehicles and were legally required to manufacture those products, yet had improperly failed to follow through with their obligations. Defendants argued the designs were defective and that they did not have an obligation to proceed with the project.
After a two-week federal trial, the jury entered a verdict for Rutan’s clients on each claim, awarding both contract and fraud damages. Rutan’s trial team intends to pursue interest on the award, which it anticipates will reach eight-figures. Although the defendants also asserted counterclaims against Rutan’s clients, the jury rejected those allegations and awarded Arctic Cat nothing.
